The LCRB has released Policy Directive 19-02 outlining changes to the penalty schedule, monetary penalties, and license suspensions. Download a copy of the policy directive here. A summary of changes are outlined below.
License Suspension and Monetary Policy
The LCRB’s fine structure is currently organized into a graduated administrative scheme comprising of four bands, depending on the severity of the contravention.
Under the new policy, the LCRB is implementing a new fine structure that introduces higher fines for some contraventions, reduces fines for some contraventions, and adjusts suspension durations. A monetary penalty amount is also introduced for Band 4 contraventions.
See the full penalty schedule (effective June 5, 2019) here.
Under the current policy, if a licensee commits the same contravention two or more times within a 12-month period, they are subject to the associated second or subsequent policy.
Under the new policy, the 12-month period has been extended to a 24-month period.
These policy changes are effective June 5, 2019. The amended penalty schedule only applies to contraventions arising after the new penalty schedule has taken effect.
